JUVE Patent comments on the KUBOTA decision

Sandrine Bouvier-Ravon, Partner at Plasseraud IP Avocats, is quoted in an article in JUVE Patent - one of the leading publication on the European patent market - published on September 19 2023, concerning the Supreme Court's harmonization with EPO regulations.

The article mentions that following a decision by the French Cour de cassation, INPI must now adapt its practice to follow that of the EPO regarding when parties can file a French divisional patent FR 18 51806 from the former.

This decision by the French Supreme Court stems from a dispute between Japanese agricultural and construction machinery manufacturer Kubota, represented by Sandrine-Bouvier with Didier Intes and Gaston Vedel for Cabinet Beau de Loménie, and INPI.

The CNCPI intervened in this ruling, which is of major importance to the French patent community.
