Ina Schreiber shares her opinion with Managing IP on creating IP-focussed divisions at a EU level
Ina Schreiber, Partner at Plasseraud IP and UPC (Unified Patent Court) expert at the CNCPI (Compagnie nationale des conseils en propriété industrielle), shared her opinion with Managing Intellectual Property on creating IP-focussed divisions at a EU level.
According to her, to have judges specialised in IP at the CJEU would be very helpful, especially for supplementary protection certificate (SPCs) cases. The SPCs, applied to specific pharmaceutical and plant protection products, require a good understanding of the patent regulations and the scope of protection conferred by the patent.
Moreover, specialised patent judges at the CJEU should be a "must" in order to "guarantee high level decisions and efficient harmonisation of case law", if the Unified Patent Court comes into operation.
